1. Freeride Spirit

FreeRide Spirit is a tour operator that organizes Tours with and without Guide in Portugal.

2. Minimum Period of Tours

2.1. Enduro Tours

The minimum period of Tours is 2 days, and any fraction of a day will be considered as one day.

2.2. Tours Adventure

The minimum period of Tours is 1 day, and any fraction of a day will be considered as one day.

3. Customer Age

Customer must have completed 18 years of age.

The client can be 16 years of age if he has written parental permission and a valid and updated European driving license for the motorcycle he is going to drive.

4. Customer Experience

Customer's experience is not required to pilot the type of bikes used in the Tours, however, the Customer should be aware that riding a motorcycle is associated with a high risk of falling.

At the beginning of each Tour, a briefing will be done on the operation of the bike and the Tour, as well as preventive driving techniques to minimize the aforementioned risk.

5. Driving License

It is necessary and obligatory for the Client to have the current and valid driving title in Portugal, with qualifications for the vehicle that will be driven during the Tour.

6. Prices

Tours prices are calculated and submitted to the customer at the time of booking the Tour.
As a rule, these prices include unlimited kilometers, insurance against third parties, collision insurance for damages of a higher value than the mandatory deductible, and the use of necessary equipment for the pilot and companion.

7. Unlimited Kilometers

The Client is free to move on the bike used in the Tour after completing the Freeride Spirit route, and this freedom can only be used up to the last day of the Tour.
On that day, the motorcycle must be delivered as soon as the itinerary is completed.

In the case of Enduro Tours, it is the Client's obligation to follow the Tour Leader throughout the Tour. If for any reason he decides to leave the Tour, he must leave the motorcycle and equipment assigned to the assistance team.

8. Reservations and Payment Conditions

At the moment of booking the Tour, the customer will pay 50% of the total cost of their Tour to ensure the availability of the bike.

The remaining 50% will be paid two weeks prior to the Tour start date.

9. Motorcycle Availability

FreeRide Spirit is committed to ensuring the availability of the bike requested for the Tour for the duration of the Tour.
If for unforeseeable circumstances FreeRide Spirit is unable to provide the customer with the reserved motorcycle model, the nearest equivalent model available may replace the reserved motorcycle.

10. Pilot Equipment Availability

Freeride Spirit offers the Customer a set of equipment consisting of helmet, windbreaker, gloves, pants, boots, and rain suit that must be delivered at the Tour Term.

The availability of the equipment is only guaranteed when the Customer confirms the required sizes in the Freeride Spirit Questionnaire immediately after booking the Tour.

If the Customer does not respond to the questionnaire, the availability of the equipment is not guaranteed.

The customer is responsible for the proper use and preservation of the equipment during the Tour.

If the Customer damages the equipment intentionally, he is responsible for replacing the damaged material with a new one of the same make and model.

11. Cancellation
  1. Any and all cancellations must be communicated to Freeride Spirit by email, and no other means of communication are permitted.
  2. The Customer has 14 days after purchase to cancel the reservation, being refunded the full amount already paid.
  3. If there are any return costs, these must be borne by the customer.
  4. If the Customer wishes to cancel after the 14-day period, he will lose all money already paid.
  5. If the cancellation is partial (only some days of the tour), the same cancellation policy applies to the canceled days.
12. Reschedule
  1. After the cancellation period, Freeride Spirit grants the customer the possibility to credit the amount already paid for a future purchase, in the following ways:
    1. If the customer reschedules more than 2 months before the start of the tour, Freeride Spirit will credit the total amount paid.
    2. if rescheduled between 15 days and 2 months, Freeride Spirit will credit half of the amount paid.
    3. if rescheduled less than 15 days before, there will be no credit.
  2. If rescheduling is partial, the same policy applies to the canceled days.
  3. The credited amount is not transferable nor can it be converted into cash.
13. Moto Delivery and Return

Deliveries and returns are planned at Freeride Spirit's headquarters (Rua Infanta Dona Maria no. 231), from Monday to Sunday at the time previously agreed.

  • Delays are subject to a fee of €10/hour.
  • Deliveries and returns at different locations are possible upon payment of a surcharge based on distance.
14. Stay and Restaurants

Hotels and Restaurants are service providers suggested by Freeride Spirit and may be changed upon availability.

  • Any change must be communicated in writing to Freeride Spirit at least 30 days in advance.
  • Cost differences will be borne by the Client or refunded accordingly.
  • Freeride Spirit is not responsible for last-minute changes or deficiencies in third-party services.
15. Term of the Tour

The Tour ends on the day, time, and place established in the contract.
Extensions must be requested 24 hours in advance and may be authorized or denied.

Unauthorized delays will incur a €1000/day penalty, and unreturned motorcycles will be reported to authorities.

16. Responsibility of Freeride Spirit

Freeride Spirit must:

  • Deliver the bike in safe, correct technical conditions.
  • Provide vehicle documents, accessories, and chosen equipment.
  • Verify existing damages in writing.
  • Provide repairs or replacements if needed.

Other claims are excluded unless due to gross or intentional negligence by Freeride Spirit.

17. Customer Responsibility

The Customer must:

  • Hold a valid license to drive in Portugal.
  • Pay all fines and charges for infractions during the Tour.

17.1. The Client must ensure the bike:

a) Is used per manufacturer’s recommendations.
b) Complies with road codes.
c) Is not used negligently.
d) Does not carry more passengers than allowed.
e) Is not used in races or competitions.
f) Is not used for illegal purposes.
g) Does not carry more weight than allowed.
h) Is not used by unauthorized persons.
i) Is not used if mechanically unsafe.
j) Is not used under the influence of drugs, alcohol, or while unfit.

Failure to comply annuls the insurance and makes the client liable for the total value of the motorcycle and accessories.

18. Release or Deposit

Each motorcycle has a specific Franchise indicated in the contract.
It can be deposited in cash or via credit authorization (Visa/MasterCard).
Compensation for damages will be deducted from this amount.

If a claim is reported, the full deductible is charged until resolution.

19. Insurance

19.1. Adventure Insurance

Includes:

  • Mandatory liability insurance.
  • Collision insurance beyond the deductible.

19.1.1. Basic Insurance

Full coverage with a €3000 franchise — customer pays up to €3000; the rest is covered.

19.1.2. Freeride Adventure Insurance

Optional — €80/day, removes franchise liability entirely.

19.2. Enduro Insurance

Includes mandatory civil liability insurance (Portugal only).

19.2.1. Basic Insurance

Third-party only — customer covers all motorcycle damages or loss.

19.2.2. Freeride Enduro Insurance

Optional — €30/day, covers damage up to €600.

19.3. Exclusions

Insurance is void if:

  • Customer leaves the scene of an accident.
  • Fails to report theft or disappearance.
  • Intentionally damages the bike.
  • Fails to notify within 3 days.
  • Drives under the influence.
  • Drives in unauthorized areas.
  • Fails to meet responsibilities outlined in §17.
20. Additional Expenses
  • Late returns: €10/hour.
  • Optional accessories (GPS, helmets, etc.) not covered by insurance.
  • Fines add an administrative fee of €50.
21. Consumables
  • The bike must be returned with a full tank — otherwise €40 fee applies.
  • The bike is delivered in perfect condition with maintenance up to date.
22. Mechanical Failure

If mechanical failure occurs:

  • Contact Freeride Spirit immediately with details.
  • Assistance or replacement will be provided if possible.
  • Refunds apply only if failure is not the customer’s fault.
  • Failures due to accidents or negligence are not refundable.
23. Procedure in Case of Accident or Damage
  • Notify Freeride Spirit immediately.
  • Repairs require Freeride Spirit’s approval.
  • Contact police/rescue if necessary.
  • Collect full details of all parties and witnesses.
24. Territory

Insurance is valid only in Portugal.
Leaving the territory voids insurance and makes the customer fully liable for all damages.

25. Tolls and Carriers

Customer is responsible for all tolls during the Tour.
Freeride Spirit will add a €50 administrative fee per toll incident.

26. Keys

Keys are provided at the start and must be returned.
Loss or damage incurs replacement fees.
Freeride Spirit is not responsible for interruptions due to lost keys.

27. Documentation

Freeride Spirit provides all necessary documents (contract, registration, insurance).
Loss of documents incurs replacement fees.

28. Screening

For safety, tracking devices may be installed.
Tampering with them is criminally punishable and liable for damages.

29. International Organs

Freeride Spirit reserves the right to report contractual breaches to authorities or regulatory bodies in the client’s country.

30. Competent Court

All disputes will be settled exclusively at the Court of the Comarca of Porto, Portugal.

31. Photos and Videos

All photos and videos produced by Freeride Spirit are its property.
They may be used for advertising unless the client is explicitly identified without written consent.

32. Rent-a-Car Contract

A rent-a-car contract is mandatory for all Tours, at no extra cost to the client.

33. Acceptance of General Conditions

By confirming the reservation, the Customer confirms that he/she has read and accepted these Terms and Conditions.
